1 Acceptance of Terms
These Terms of Service ("Terms") constitute a legally binding agreement between you ("Customer," "you," or "your") and FundCore Bank ("Bank," "we," "us," or "our"). By opening an account, accessing our website, or using any of our banking products or services, you confirm that you have read, understood, and agree to be bound by these Terms, our Privacy Policy, and any additional terms applicable to specific services.
If you are using our services on behalf of a business or legal entity, you represent and warrant that you have the authority to bind that entity to these Terms, and references to "you" shall include both you personally and that entity.
These Terms are effective as of the date you first use our services or the date shown above, whichever is earlier.
2 Eligibility
To be eligible to open and maintain an account with FundCore Bank, you must:
- Be at least 18 years of age (or the age of majority in your jurisdiction)
- Be a legal resident or citizen of a jurisdiction where we are licensed to operate
- Provide accurate, complete, and current personal identification information as required
- Not be subject to any sanctions, restrictions, or legal prohibitions that would prevent you from banking with us
- Successfully pass our identity verification and Know Your Customer (KYC) process
- Not have had an account with us previously terminated for cause
We reserve the right to refuse service or close existing accounts at our sole discretion if we determine that eligibility requirements are not met or are no longer met, or where required by law or regulation.
3 Account Opening & Management
3.1 Account Application
When applying to open an account, you agree to provide truthful, accurate, and complete information. Any misrepresentation or omission may result in immediate account closure, legal action, and reporting to relevant authorities.
3.2 Account Ownership
Accounts are personal and non-transferable. You may not assign, sell, transfer, or otherwise convey your account or any rights associated with it to any third party without our prior written consent.
3.3 Account Maintenance
You are responsible for maintaining accurate and up-to-date contact information, including your email address, phone number, and mailing address. You must notify us promptly of any changes to your personal or business information. Failure to maintain accurate information may affect your ability to access our services.
3.4 Minimum Balance
Certain account types may require a minimum balance to avoid fees or to remain active. Please refer to our current Schedule of Fees and the specific terms for your account type. We reserve the right to close accounts that fall below the required minimum balance after appropriate notice.
3.5 Inactive Accounts
Accounts with no customer-initiated transactions for a period of 12 consecutive months may be classified as inactive. Inactive accounts may be subject to dormancy fees as outlined in our Schedule of Fees. After an extended period of inactivity as required by applicable law, account funds may be remitted to the relevant government authority as unclaimed property.
4 Banking Services
Deposits & Withdrawals
Funds may be deposited and withdrawn subject to transaction limits, processing times, and applicable verification requirements.
Fund Transfers
Transfer funds between your accounts or to other account holders. Transfers are subject to daily limits and may require additional verification.
Payment Cards
Virtual and physical debit/credit cards are issued subject to our card terms. Cards may be suspended or cancelled for suspicious activity.
Loans & Credit
Loan products are subject to credit assessment, approval criteria, and separate loan agreement terms which will be provided at the time of application.
Bill Payments
Bill payment services are provided for convenience. We are not responsible for errors arising from incorrect payee information submitted by the customer.
Customer Support
Our support team is available to assist with account inquiries, disputes, and technical issues during published business hours.
We reserve the right to modify, suspend, or discontinue any service at any time with reasonable notice to affected customers, except where immediate action is required for security or regulatory reasons.
5 Fees & Charges
By using our services, you authorise FundCore Bank to deduct applicable fees and charges from your account balance. Our current Schedule of Fees is available in your account settings and on our website. Key fee provisions include:

We will provide at least 30 days' notice before implementing new fees or increasing existing fees, except where required by law or regulation to act sooner. Continued use of our services after the effective date of a fee change constitutes your acceptance of the new fee schedule.
6 Security & Access
6.1 Credentials
You are solely responsible for maintaining the confidentiality and security of your account credentials, including your username, password, PIN, and any multi-factor authentication (MFA) devices. You must not share your credentials with any third party under any circumstances.
6.2 Unauthorised Access
You must notify us immediately and no later than 24 hours upon discovering or suspecting any unauthorised access to your account, suspicious transactions, or loss or theft of credentials. You may be held liable for losses resulting from unauthorised transactions if you fail to notify us promptly.
6.3 Device & Session Security
You are responsible for ensuring that the devices you use to access our services are free from malware, viruses, and keyloggers. Always log out completely after each online banking session, particularly when using shared or public devices. We are not responsible for losses arising from your failure to maintain device security.
6.4 Multi-Factor Authentication
We strongly recommend enabling multi-factor authentication (MFA) on your account. For certain high-value transactions or account changes, MFA may be required. We reserve the right to mandate MFA at any time to protect customer security.
6.5 Monitoring
We continuously monitor accounts for unusual or suspicious activity. We may place temporary holds, request additional verification, or restrict account access if we detect activity that may indicate fraud, money laundering, or other prohibited conduct. We will attempt to contact you promptly if such action is taken.
7 Prohibited Activities
You agree not to use our services for any unlawful, fraudulent, or abusive purpose. Without limitation, the following activities are strictly prohibited:
- Money laundering, terrorist financing, or any activity that violates anti-money laundering (AML) laws
- Processing payments or transactions related to illegal goods, services, or activities
- Providing false, misleading, or fraudulent information in connection with your account
- Using automated scripts, bots, or tools to access or interact with our services in an unauthorised manner
- Attempting to circumvent, disable, or interfere with our security systems or fraud prevention measures
- Using the account of another person without their knowledge and express consent
- Conducting transactions that violate sanctions laws, trade restrictions, or embargoes
- Facilitating or assisting any third party in conducting any of the above activities
- Engaging in any activity that could damage, disable, or impair our systems, infrastructure, or reputation
Violation of these prohibitions may result in immediate account suspension or termination, reversal of transactions, reporting to law enforcement or regulatory authorities, and civil or criminal legal action.
8 Limitation of Liability
To the maximum extent permitted by applicable law, FundCore Bank shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, loss of business opportunity, or loss of goodwill, even if advised of the possibility of such damages.
Our total aggregate liability to you for any claim arising under or in connection with these Terms or your use of our services shall not exceed the total amount of fees you paid to us during the three (3) months immediately preceding the event giving rise to the claim.
Nothing in these Terms shall exclude or limit our liability for:
- Fraud or fraudulent misrepresentation by us
- Death or personal injury caused by our negligence
- Any liability that cannot be excluded or limited by applicable law
We are not liable for service interruptions caused by circumstances outside our reasonable control, including acts of God, natural disasters, power failures, internet outages, cyber attacks, government actions, or third-party service provider failures.
9 Account Termination
9.1 Termination by You
You may close your account at any time by contacting us through our support channels. Before closure, all outstanding balances, pending transactions, and applicable fees must be settled. Remaining funds will be returned to you via your chosen method within a reasonable timeframe, typically 5–10 business days.
9.2 Termination by Us
We reserve the right to suspend or terminate your account and access to our services, with or without prior notice, for any of the following reasons:
- Violation of these Terms or any applicable law or regulation
- Suspected fraud, money laundering, or other financial crime
- Inaccurate or fraudulent information provided during account opening or maintenance
- Failure to complete required identity verification procedures
- Account inactivity beyond the dormancy period
- Business, legal, or regulatory requirements that necessitate account closure
9.3 Effect of Termination
Upon termination, your right to use our services immediately ceases. Provisions of these Terms that by their nature should survive termination will continue to apply, including but not limited to Sections 7, 8, 10, and 11.
10 Dispute Resolution
10.1 Transaction Disputes
If you believe a transaction on your account is unauthorised or erroneous, you must notify us in writing within 60 days of the transaction date. We will investigate and respond within 10 business days, or up to 45 days for complex cases. If we determine the transaction was unauthorised, we will restore your account balance accordingly.
10.2 Informal Resolution
Before initiating any formal dispute process, you agree to first contact our customer support team and allow us a reasonable opportunity (at least 30 days) to resolve the issue informally. Most disputes can be resolved quickly through direct communication.
10.3 Binding Arbitration
Any dispute, claim, or controversy arising out of or relating to these Terms or your use of our services that cannot be resolved informally shall be resolved through binding arbitration in accordance with the rules of a recognised arbitration body. You waive your right to participate in class action lawsuits to the fullest extent permitted by applicable law.
10.4 Exceptions
Notwithstanding the arbitration agreement, either party may seek urgent injunctive or equitable relief in any court of competent jurisdiction to prevent irreparable harm.
11 Governing Law
These Terms and any dispute or claim arising out of or in connection with them shall be governed by and construed in accordance with the laws of the jurisdiction in which FundCore Bank is registered and holds its primary banking licence, without regard to its conflict of law provisions.
Subject to the arbitration clause in Section 10, you agree to submit to the exclusive jurisdiction of the courts located in that jurisdiction for the resolution of any disputes not subject to arbitration.
If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
12 Changes to Terms
We may revise these Terms at any time. When we make material changes, we will:
- Update the "Last updated" date at the top of this page
- Send an email notification to your registered email address at least 30 days before the changes take effect
- Display a prominent notice in your online banking portal
Your continued use of our services after the effective date of any revised Terms constitutes your acceptance of those changes. If you do not agree with the revised Terms, you must close your account before the effective date.
